Welcome to Anny.trade. We offer an online software as a service (SaaS) through our website https://www.anny.trade (the "Website") and mobile applications for iOS and Android (the "App"). Together, the Website and the App are referred to as the "Platform".

Our software ("Software") is an AI-powered crypto portfolio intelligence platform. It provides artificial intelligence-driven market analysis, portfolio insights, strategy backtesting and optimization, automated trading tools, and conversational AI assistance to help you make informed decisions about your cryptocurrency portfolio.

These terms and conditions (the "Terms") apply to the relationship between Anny.trade and you for any use of the Platform and the Software that Anny.trade offers. You cannot use the Software without accepting these Terms.

Definitions

Anny.trade: A product developed and licensed by MECABOTS LTDA, a company incorporated under Brazil's law. Anny.trade is also referred to as "we", "us", or "our".

User(s): Individual private person(s) or legal entity that makes use of the Platform or Software. Users are also referred to as "you" or "your".

Guest User: A person who accesses certain limited features of the Software (such as the Ask Anny conversational AI) without creating an account or logging in.

Software: The technology platform developed by Anny.trade, available at https://www.anny.trade and through mobile applications, comprising the features described in these Terms.

Ask Anny: The conversational AI assistant powered by third-party large language models (LLMs) that provides market analysis, portfolio insights, and general support to Users.

AI Insights: Automated AI-generated analysis of a User's portfolio, positions, and market conditions.

Anny Line (CFO Indicator): A proprietary market state indicator developed by Anny.trade that evaluates cryptocurrency market conditions. The Anny Line is a technical indicator, not a trading signal or investment recommendation.

Credits: The unit of consumption used to access certain AI-powered and computational features of the Software. Credits are purchased or allocated as part of a subscription plan.

Exchange(s): Third-party cryptocurrency trading platforms (such as Binance, Bybit, OKX, Kraken, and others) that Users may connect to the Software via API keys or OAuth.

Bot(s): User-configured automated trading strategies within the Software that can monitor markets and execute trades on connected Exchanges based on User-defined rules.

Backtest: A computational simulation that tests a trading strategy against historical market data.

Optimizer: A computational tool that analyzes and suggests improvements to trading strategy parameters.


Registration and Personal Account

To use the full features of our Platform, please visit https://www.anny.trade. You will need to register and create a personal account. Registration is available via email/password or through third-party authentication providers (Google, Apple, Facebook, X/Twitter) via Firebase Authentication.

Certain limited features (such as Guest Ask Anny) may be accessed without creating an account, subject to the Guest Access section below.

You must protect your account login details and keep your password strictly secret. We will assume that all actions taken on your account are done by you or under your supervision.

You agree to provide updated, complete, and accurate information about your account. You agree to promptly update your personal account as necessary so we can contact you if required.

All questions and directions transmitted to the contacts entered in your personal account will be considered received by you.


Guest Access

Certain features of the Software may be accessed without creating an account ("Guest Access"). When using Guest Access:

  • Your questions and interactions are processed by our AI systems and third-party AI providers (see Section on AI Features below).
  • We collect limited technical data (IP address, session identifier, browser type) to operate the service and prevent abuse.
  • Guest Access is subject to rate limiting and may be restricted or discontinued at any time.
  • Guest interactions are not linked to a registered account and cannot be retrieved after the session ends.
  • All other provisions of these Terms apply to Guest Users to the extent applicable.

Account Inactivity, Deactivation, and Data Retention

To comply with applicable data protection and privacy regulations, including but not limited to the General Data Protection Regulation (GDPR) and the Lei Geral de Protecao de Dados (LGPD), Anny.trade maintains policies regarding inactive user accounts.

An account will be considered inactive if no login, use of the Software, subscription activity, or interaction with Anny.trade services has occurred for a continuous period of 18 (eighteen) months.

If an account is classified as inactive:

  • The account may be deactivated or permanently deleted by Anny.trade.
  • Access to the account and associated services may no longer be possible.
  • Personal data, configurations, trading history, AI conversation history, credit balances, and user-generated content associated with the account may be deleted or anonymized.
  • Restoration of deleted accounts or associated data may not be possible.

Certain information may be retained after deletion where required by applicable law, regulatory obligations, fraud prevention, dispute resolution, or legitimate business purposes. Any retained data will be minimized and, where possible, anonymized.

Users may avoid account deactivation by logging into their account or maintaining active use of the services within the inactivity period.


Subscription Plans and Credits

Subscription Tiers

Anny.trade offers different subscription plans. Each plan includes a monthly allocation of Credits and access to different features. Current plans and their details are available at https://anny.trade/pricing.

The available tiers are:

  • FREE: Includes a limited monthly credit allocation and restricted access to AI and computational features.
  • PRO: Includes an expanded monthly credit allocation and access to backtesting and optimization features.
  • PRO+: Includes the largest monthly credit allocation and access to all features including advanced strategy tools.

Anny.trade may also offer promotional plans, lifetime deals (such as through AppSumo), or other special arrangements. The specific terms of such offers are communicated at the time of purchase and supplement these Terms.

Credits

Credits are the unit of consumption for AI-powered and computational features:

  • AI features (Ask Anny, AI Insights, Research Agent) are billed dynamically based on actual computational resources consumed. The cost in credits varies depending on the complexity of the request and the AI model used.
  • Computational features (Backtest, Optimizer, Walk-Forward Analysis) have fixed credit costs per execution, as displayed in the Software at the time of use.
  • Certain features (such as dashboard AI Insights) may be offered free of charge at Anny.trade's discretion.

Credit allocation and expiry:

  • Each subscription tier includes a monthly credit allocation that is refreshed at the start of each billing cycle.
  • Unused credits from the monthly allocation do not roll over to the next billing cycle.
  • Users may purchase additional credit packs on a pay-as-you-go basis. Purchased credit packs do not expire while the account remains active.
  • Credit balances are non-transferable and have no cash value.

No refunds on consumed credits: Once credits are consumed by using a feature, they cannot be refunded. The dynamic nature of AI feature billing means the exact credit cost is determined after the feature has been used.

Pricing

Prices on the Platform do not include applicable taxes and expenses.

Prices for using Anny.trade may be adjusted periodically. Subscribers will be notified of price changes at least 30 days before they take effect. Continued use of the Software after a price change constitutes acceptance of the new pricing.

Payment

Payments are processed through third-party payment providers including Stripe, PayPal, and CoinPayments. By subscribing, you agree to the terms of service of the applicable payment provider.

The subscription amount will be billed automatically each billing cycle. The payment methods are those shown on the Platform and may be changed without prior notice. It is the User's responsibility to maintain valid payment information. Failure to pay will result in automatic suspension of the service.

A monthly subscription will continue on a recurring basis unless the User cancels before the expiration of the current paid period. Cancellation will take effect at the end of the current billing cycle; no proportional refunds are granted for the current period.


AI-Powered Features

Description

The Software includes features powered by artificial intelligence and large language models (LLMs), including but not limited to:

  • Ask Anny: A conversational AI assistant that can answer questions about your portfolio, market conditions, trading strategies, and the platform itself.
  • AI Insights: Automated analysis of your portfolio positions and market conditions.
  • Research Agent: Deep multi-step research on specific assets, strategies, or market scenarios.
  • AI Customer Support: An AI-powered support system that can answer questions, troubleshoot issues, and escalate to human support when necessary.
  • Intelligence Engine: Automated market state analysis and risk scoring.

Third-Party AI Processing

To provide AI features, User data (including but not limited to chat messages, portfolio information, position data, and market context) is transmitted to and processed by Anthropic, PBC ("Anthropic"), a US-based company, via their Claude AI API. This constitutes a cross-border data transfer from the EU (where our infrastructure is hosted) to the United States. See our Privacy Policy for detailed information about this data processing.

AI Disclaimer

AI-generated content is provided for informational purposes only and does not constitute financial, investment, tax, or legal advice.

You acknowledge and agree that:

  1. AI-generated analysis, insights, and suggestions may contain errors, inaccuracies, or "hallucinations" (plausible-sounding but incorrect information).
  2. Past performance data, backtest results, and optimization outputs do not guarantee future results.
  3. AI outputs are based on the data available at the time of generation and may not reflect current market conditions.
  4. You bear full responsibility for any trading or investment decisions you make, whether or not they are informed by AI-generated content from the Software.
  5. MECABOTS is not a registered investment advisor, broker-dealer, or financial planner in any jurisdiction.
  6. AI-generated content should not be the sole basis for any investment decision.
  7. The Anny Line (CFO Indicator) is a market state indicator, not a trading signal or investment recommendation.

Automated Trading Features

The Software allows Users to configure automated trading strategies ("Bots") and automated rules ("Anny Line Rules") that can execute trades on connected Exchanges without manual intervention. By using these features, you acknowledge and agree that:

  1. You are solely responsible for configuring and monitoring your automated trading strategies.
  2. Automated trades are executed based on your settings and market conditions; Anny.trade does not control or guarantee the outcome of any trade.
  3. Market conditions, exchange outages, network latency, and other factors may cause trades to execute at prices different from expected ("slippage").
  4. You should never allocate funds to automated trading that you cannot afford to lose.
  5. Anny.trade is not responsible for losses resulting from misconfigured strategies, exchange API failures, or market volatility.

Exchange API Keys and OAuth

To enable trading features, you may connect your Exchange accounts to the Software by providing API keys or authorizing OAuth connections.

You acknowledge and agree that:

  • API keys are encrypted using industry-standard encryption (AES-256) and stored in our database with unique salts per user.
  • Anny.trade requests only the minimum permissions necessary (read and trade). We never request or store withdrawal permissions.
  • OAuth tokens for supported exchanges are automatically renewed as required.
  • You may revoke Exchange connections at any time through the Platform settings or directly on the Exchange.
  • Upon account deletion, all stored API keys and OAuth tokens are permanently deleted.
  • Anny.trade does not have access to trading information that was not originated through the Software.

Tax Calculation Tools

The Software may provide tax estimation tools (such as Brazilian DARF calculations). These tools are provided for informational convenience only.

Anny.trade is not a tax advisor. Tax calculations are estimates and may not reflect your actual tax obligations. You are solely responsible for consulting a qualified tax professional and filing accurate tax returns in your jurisdiction.


Fair Use of Our Platform

By using our Platform, you declare to be at least 18 years old.

You may not use the Platform in such a way that you violate Brazilian law or any other applicable laws and regulations in your jurisdiction.

As a condition of using the Platform, you agree not to provide any information that is incorrect, inaccurate, incomplete, or in violation of any law or regulation. In addition, you agree that you will not, and will not allow third parties to:

  1. Enter any non-public or secure area of the Platform;
  2. Send viruses, worms, junk mail, spam, chain letters, unsolicited offers, or advertisements of any kind;
  3. Investigate, scan, or test the Platform or any related system or network, or breach any security or authentication;
  4. Use any automated software system to remove data from the Platform ("screen-scraping"), except as explicitly permitted through our API;
  5. Make and distribute copies of the Platform;
  6. Attempt to sell, distribute, copy, rent, sublicense, lend, merge, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, translate, hack, damage, or misuse the Platform;
  7. Disrespect the rules and terms of use of connected Exchanges;
  8. Attempt to manipulate or abuse the credit system, including creating multiple accounts to obtain free credits;
  9. Use AI features to generate content for competing services;
  10. Or create derivative works of any kind.

You cannot create an account with someone else's name or act like someone else in any other way. If it is a corporate account, only the legal representative may operate the account.

Anny.trade has the right to block your account (temporarily or permanently) and deny Platform access if we suspect account or site abuse, or if you do not comply with these Terms.


Relationship with Third-Party Software

To enable trades with crypto assets, Anny.trade needs the User's API credentials to access the Exchange, and the User needs to have an open, active, and properly configured account with at least one of the supported Exchanges.

Anny.trade does not have access to any trading information that was not originated and/or finalized through the Software.

The Software integrates with various third-party services. Your use of these third-party services is subject to their respective terms of service and privacy policies. Anny.trade is not responsible for the availability, accuracy, or security of third-party services.


Privacy

Anny.trade respects your privacy and complies with the General Data Protection Regulation (GDPR) and the Lei Geral de Protecao de Dados (LGPD). When you make use of our Platform, we collect certain personal data from you, including data that is processed by third-party AI providers. In our Privacy Policy, you can read what personal data we collect, how it is processed, and for what purposes. You can find our privacy policy at: https://anny.trade/privacy-policy


Intellectual Property

Anny.trade is licensed and owns all intellectual property rights acquired and related to the Software, including but not limited to patents, patent applications, trademarks, trademark applications, database rights, trade names, copyrights, trade secrets, licenses, domain names, know-how, proprietary algorithms (including the Anny Line / CFO Indicator), AI model fine-tuning, proprietary rights and processes ("Intellectual Property Rights").

Anny.trade grants its Users a non-transferable, non-exclusive, revocable license intended for the fair use of the Platform and the Software on a subscription basis as offered at https://anny.trade. You are not permitted to access Platform content for any other purpose, such as selling or distributing Platform content.

AI-generated content (such as Ask Anny responses and AI Insights) is provided for your personal use. You may not systematically extract, reproduce, or redistribute AI-generated content for commercial purposes.


Platform Availability and Disclaimer of Warranties

The Platform is available on desktop and mobile devices running iOS and Android. Anny.trade will use reasonable efforts to make the Platform available at all times.

However, the User acknowledges that the Platform is provided over the Internet and mobile networks and therefore its quality and availability may be affected by factors beyond Anny.trade's reasonable control, including but not limited to:

  • Internet and network outages
  • Third-party Exchange API failures or rate limiting
  • Third-party AI provider (Anthropic) service disruptions
  • Scheduled and unscheduled maintenance
  • Force majeure events

Anny.trade does not accept any responsibility for the unavailability of the Platform, or any difficulty or inability to download or access content, or any other failure in the communication system that may result in the unavailability of the Platform.

Anny.trade may, at its own discretion, update, modify, or adapt the Platform, modifying its functionality to improve the user experience. Anny.trade is not responsible for any downtime resulting from these actions.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


Helpdesk and Support

Anny.trade provides customer support through:

  • AI-powered support via the Ask Anny conversational interface, which can answer common questions and troubleshoot issues.
  • Human support via email at [email protected] for issues that require human attention.

Support is limited to questions about the functioning of the Platform. All trading operations and interactions with Exchanges are the sole responsibility of the User.


Anny.trade explicitly DOES NOT:

  • Provide users with personal financial, investment, tax, or legal advice.
  • Make investment recommendations or endorse any particular trading strategy.
  • Guarantee any financial outcome from using the Software.

You acknowledge that:

  • All AI-generated analysis, insights, backtest results, optimization outputs, and market indicators (including the Anny Line) are informational tools, not investment advice.
  • Anny.trade may provide general educational content (tutorials, videos, articles) about cryptocurrency markets and the Software. This content is general in nature and does not constitute personal advice.
  • The use of any automated trading feature, AI insight, or analytical tool is the sole responsibility of the User.

Risks

The User is aware of and assumes full responsibility for the risks associated with:

  • The possession, trade, and use of crypto assets, including total loss of value.
  • The use of automated trading systems, including the risk of rapid and significant losses.
  • Reliance on AI-generated analysis, which may be inaccurate or incomplete.
  • The security risks associated with connecting Exchange accounts via API.
  • The regulatory risks associated with cryptocurrency trading in the User's jurisdiction.
  • The volatility of cryptocurrency markets, which can result in significant losses in short timeframes.

Responsibilities

Anny.trade is not responsible for any damage (direct or indirect) you may suffer as a result of using the Platform or the content provided. For example, Anny.trade is not responsible for:

  • The proper functioning of hyperlinks provided by the Platform;
  • The accuracy, completeness, or reliability of AI-generated content;
  • The (lack of) financial benefit to Users through the use of the Platform;
  • Losses resulting from automated trading, including misconfigured strategies, slippage, or exchange failures;
  • Any situation in which the User's device, login details, API keys, and/or password are stolen and any third party subsequently makes use of the Platform without the User's consent;
  • Any damage or alteration to your equipment as a result of the installation or use of the Platform;
  • Failure to comply with any obligation under these Terms when such failure is due to events beyond Anny.trade's reasonable control;
  • The actions, omissions, or insolvency of any connected Exchange;
  • Errors or inaccuracies in tax estimation tools.

IN NO EVENT SHALL ANNY.TRADE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO ANNY.TRADE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.


Indemnification

Users will indemnify, defend, and hold Anny.trade harmless from and against all liabilities, damages, and costs (including settlement costs and reasonable attorney's fees) arising from third-party claims about:

  • Any damage resulting from the User's behavior related to the use of our Platform;
  • Violation by the User of these Terms or any applicable law or regulation;
  • Any trading losses or financial damages arising from the User's use of automated trading features;
  • Any misuse of AI-generated content.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Brazil. The provisions of Brazilian consumer protection law (Codigo de Defesa do Consumidor) shall apply where mandatory.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Brazil, without prejudice to the User's right to submit claims to the courts of their habitual residence where mandatory consumer protection laws so require.


General Terms

Anny.trade reserves the right to change these Terms. When material changes are made, Users will be notified by email and/or through the Platform. By continuing to use the Platform after such notification, the User acknowledges and accepts the most recent version of these Terms.

If we do not enforce any provision of these Terms, it will not be construed as consent or waiver of the right to enforce it at a later time or against another User.

Users may not transfer the rights and obligations of these Terms to third parties.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Anny.trade strives to provide the best possible service. If you have a complaint, comment, or suggestion, you can contact us at [email protected]. Please provide your contact details, a description, and a clear reason for your complaint. Complaints are usually processed within 7 business days.
